Photo usage

Marketing use is included

Unless different terms are agreed in writing, the photography fee includes a non-exclusive, worldwide licence for the named client to use the final delivered photographs in their business and property marketing. The licence starts when the final photographs are delivered, has no expiry and carries no additional repeat-use fees.

This includes property listings, listing platforms, brochures, signage, websites, social media, advertising, presentations and company portfolios.

Your team can use the images too

If a broker, manager or agency commissions the photography for a property owner, that owner may also use the photographs to market the photographed property. The client can share images with appointed brokers, property managers, designers, printers and marketing providers for these purposes, including publication on listing and advertising platforms.

That permission does not give providers an independent right to sell or license the photographs for unrelated use.

Normal edits are welcome

Cropping, resizing, text overlays and normal layout adjustments are permitted. A photo credit is appreciated, but not required. Images must not be used to make misleading claims about a property or imply an endorsement by a person or business shown.

Copyright and other uses

Copyright remains with the photographer unless a separate written agreement states otherwise. Permission for routine edits and omission of credit is not a general waiver of the photographer’s moral rights.

Selling the photographs as stock or standalone image products, or licensing them to unrelated third parties for independent use, requires a separate agreement. Any exclusive or different usage arrangement should be discussed before the shoot.

These permissions cover photographic copyright, not third-party rights in people, artwork or brands depicted. Tell me about your intended campaign so any additional permissions can be considered before the shoot.

These standard terms apply when included in your quote and accepted for that booking. They do not replace previously agreed client terms. ZOLS’s publication of client work in its own portfolio is handled separately.
